Generic Terms And Conditions

The Terms and Conditions outlined below, in conjunction with the Privacy Policy available at https://www.prepcohealthcare.com (referred to as the "Privacy Policy"), specific terms for vouchers ("Voucher T&Cs"), and any updates to policies and disclaimers published on https://www.Prepcohealthcare.com, together form the binding agreement (referred to as the "Agreement" or "Terms of Use") between PREPCO Healthcare OPC private limited,(CIN U86909TN2024OPC175593) with its registered office at No. 50, Thirumangalam Road, Anna Nagar West, Chennai - 600040, and the user ("Member" or "you"). This Agreement governs the use of services offered by PREPCO Healthcare, including those available to valid, active members.

TERMS OF USE AGREEMENT AND SERVICE DISCLAIMERS

By accessing or utilizing any of the Services, you acknowledge and agree to comply with the Terms of Use outlined in this agreement. Your use of the Services signifies your explicit acceptance of these terms, and you consent to be legally bound by them. It is crucial that you carefully review these Terms of Use. If you do not agree with or are unable to comply with any provision of this agreement, you must refrain from selecting the "I Agree" option, completing the registration process, or accessing or utilizing any of the Services.

You affirm that you will not use the Services unless you fully understand, agree to, and intend to adhere to all terms outlined herein. Failure to comply with these Terms of Use may result in legal actions. Please note that these Terms of Use do not confer any rights to third parties who are not party to the Agreement. Any violation of the terms may lead to legal consequences, and the Company retains the right to enforce its provisions.

At Prepco Healthcare, there are no age restrictions; our services are available to individuals across all age groups, from newborns to seniors. Furthermore, all pre-existing conditions are covered under our healthcare services.

For assistance, the PREPCO Healthcare helpdesk is available daily from 8:00 AM to 8:00 PM, excluding national holidays. Certain Services may be unavailable on Sundays. You can contact the helpdesk at the phone number - 1800 202 2447 . The helpdesk is your point of contact for queries and support related to the Services. Please ensure that you are aware of the availability schedule to avoid any inconvenience.

It is important to clarify that the Company is not a merchant, manufacturer, or direct provider of medical services, with the exception of offering virtual health services. The Company does not make any express or implied warranties regarding the description, quality, or suitability of the Services for any particular purpose. Furthermore, the Company disclaims all implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. The Company does not authorize any third party to make warranties on its behalf. Additionally, both the Company and any Medical Service Providers involved reserve the right to modify their fees at any time.

 

THE SERVICES PROVIDED BY THE COMPANY ARE NOT INTENDED TO BE HEALTH INSURANCE POLICIES.

Access to Medical Services

The Services provided to Members offer discounted access to medical services through Medical Service Providers (MSPs) at designated locations, alongside virtual healthcare options. It is important to note that the benefits associated with these Services are not applicable if you are claiming insurance benefits for the medical services rendered. This distinction ensures clarity between the use of the Services and insurance claims for covered treatments.

Independence of Medical Service Providers

Medical Service Providers are independent professionals or entities operating in private practice. They are neither employees nor agents of the Company or its affiliates, subsidiaries, or parent companies. This means that the Company does not exercise control over the MSPs' practices, and the relationship between the Company and the MSP is purely transactional.

Company’s Non-Endorsement of Providers

The Company does not provide endorsements or recommendations for any specific Medical Service Provider. Additionally, it does not promote any individual provider’s name or practice. The purpose of this non-endorsement is to maintain impartiality and avoid conflicts of interest, ensuring that Members have access to a diverse range of healthcare options.

Limitation of Liability

The Company makes no representations or warranties regarding the Medical Service Providers or the quality of the healthcare services they provide. The Company is not liable for any breach of service, deficiency, or other issues arising from the healthcare services offered by the Medical Service Providers. This limits the Company’s responsibility and establishes clear boundaries for its role in the service provision.

Usage Restrictions and Legal Compliance

You agree to use the Services only in lawful ways and refrain from engaging in any conduct that may harm the Company, its Medical Service Providers, or other stakeholders. Should the Company suspect any illegal, fraudulent, or wrongful activities, it reserves the right to report these actions to the relevant authorities, including government agencies and law enforcement, for further investigation.

Company’s Right to Modify Services

The Company reserves the right to make enhancements, updates, or corrections to any aspect of the Services. This includes addressing errors or omissions in the terms related to the Services or any vouchers provided. These updates may occur periodically, and Members are encouraged to stay informed about any changes that may affect the use of their benefits.

Consent for Communication

By utilizing the Services, you provide explicit consent to be contacted by the Company or its representatives via telephone, SMS, or other communication channels. This includes promotional communications regarding products and services, even if your mobile number is registered with Do Not Disturb (DND) or Do Not Call (DNC) lists. This consent is comprehensive and extends to all forms of communication.

Non-transferability of Coupons and Vouchers

Coupons, vouchers, and offers provided as part of the Services are non-transferable and cannot be redeemed for cash under any circumstances. These benefits are solely for the use of active Members and are subject to expiration. In some rare cases, the Company may offer vouchers to non-members, who must agree to the terms and conditions outlined in the Agreement.

Liability for Medical Advice

The Company and Medical Service Providers are not liable for any damages resulting from the use of the Services, including any health-related issues stemming from inaccurate or incomplete information provided by you. The Company’s virtual health services and medical advice are contingent upon the completeness of the data shared by Members. Any misinterpretation of advice is not the responsibility of the Company.

Limitations on Damages and Modifications

The Services are provided on an "As Is" and "As Available" basis, with no guarantees of performance. Neither the Company nor any Medical Service Provider will be held liable for any indirect, consequential, or punitive damages arising from the use of the Services. This limitation of liability is in full effect as per the relevant laws in the jurisdiction and is capped at the total amount paid for the Services within the 12 months preceding the claim. Furthermore, the Company retains the right to refuse, modify, or discontinue Services at any time without incurring liability.

 

ENROLLMENT TERM

Upon payment of the initial membership fee, including any applicable enrollment, processing, or other associated fees, and upon the Company's receipt of such payment, you will be granted Member status. You will gain access to the Services from the effective membership date until the expiration date specified on the Company-issued membership card, which will be provided to you.

 

CANCELLATION

If a Member wishes to cancel or terminate their membership, they may do so by notifying the Company via phone or email within 15 days of receiving the E-kit /Welcome kit. In such cases, the amount paid by the Member will be refunded or credited to the original payment method. After the 15-day period from the date of receipt of the welcome kit, no refunds will be processed under any circumstances.

 

MEMBERSHIP RENEWAL / RENEWAL FEES

The Company shall notify members of the impending expiration of their membership at least one month prior to the membership card's expiry date, and it is the member's responsibility to ensure that the renewal payment is received by the Company no later than two weeks before the expiry date. The Company shall not be held liable for any interruption or cessation of service access resulting from delayed renewal payments, the inability to process or encash payment cheques, or dishonoredcheques, for which a penalty may be imposed. Service access will be suspended from the membership card's expiration date until the Company has received full payment for the subsequent membership term, and all service benefits will be suspended immediately upon membership expiration until the renewal process is successfully completed. To verify renewal charges, members should contact the helpdesk at least one month before the membership's expiration date.

 

LOST CARD

In the event of a lost membership card, irrespective of the cause, the Company will issue a duplicate card for a fee of Rs. 100/- per card (plus applicable taxes). The membership validity will remain unaffected and will be reflected on the replacement card as per the original membership terms. You will bear full responsibility for any actions or transactions carried out using your membership until the loss is reported to the helpdesk.

 

COMPLAINTS

Members should direct any complaints to our representatives through the contact number or email on the Company’s website. If the response is unsatisfactory, the matter can be escalated by writing to our registered office or emailing info@prepcohealthcare.com. Members cannot assign or transfer their rights or obligations under these Terms of Use without prior written consent from the Company. The Company reserves the right to modify these Terms of Use at its discretion without prior notice. Any additional terms, disclaimers, privacy policies, and other relevant documents are part of these Terms of Use. The Company’s website may include hyperlinks to external websites, applications, content, or services provided by third parties, such as advertisers and e-commerce platforms (collectively referred to as "Third-Party Websites"). By clicking on such links, you do so at your own risk. Your interactions with and use of any Third-Party Websites, as well as any content on them, are subject to the terms of service of those respective websites. The Company does not assume any responsibility or liability for your use of Third-Party Websites and does not endorse or verify the accuracy or reliability of any content or services provided by these linked websites.

 

INTANGIBLE ASSESTS

The Company values intellectual property rights and expects users to respect these rights as well. All content on the Company’s website, including products, coupons, vouchers, and packages, is protected under applicable intellectual property laws. The Company, along with its licensors, retains exclusive ownership of the intellectual property rights to the website, including any software, techniques, and processes used in connection with it, as well as the associated products, coupons, vouchers, and packages. By accessing and using the website, you are not granted any implied or express rights to these materials.

The Company and/or its licensors also hold proprietary rights over the trademarks and names featured on the website, including but not limited to "PREPCO Healthcare"which are protected as trademarks and/or copyrights (or other intellectual property rights). Any unauthorized use of these marks or intellectual property, unless explicitly authorized through a written agreement, constitutes infringement and may result in legal action under applicable laws.

By using the Company’s website in accordance with this Agreement, you are granted a limited, royalty-free right to access and use the website solely for personal, non-commercial purposes within India and for the duration of your membership. This Agreement does not, under any circumstances, grant you a license to the Company’s intellectual property rights, whether by estoppel, implication, or otherwise. You agree not to reproduce, modify, sell, distribute, mirror, frame, republish, download, transmit, or create derivative works based on any part of the Company’s website, products, coupons, vouchers, or packages. You are also prohibited from removing or altering any copyright, trademark, or other ownership notices present on the website or related content.

 

AFFIRMATIONS AND ASSURANCES

By accepting the Terms of Use, you affirm and guarantee the following: 

  1. By accepting these Terms of Use, you confirm that you are at least 18 years old and will comply with all applicable laws and regulations while using the Services. If a minor (under 18 years old) accesses the Services through your Membership, you agree to ensure their compliance with these Terms and take full responsibility for any breaches or violations caused by the minor. Any non-compliance or violations by the minor will be attributed to you.

 

  1. Kids Plan -The following terms and conditions govern the eligibility of children to access the preventive healthcare plan with parental or guardian consent. In this arrangement, the parent or guardian will be designated as the primary member on behalf of the minor child. However, the parent or guardian will not be eligible to access the plan’s benefits, as these are exclusively intended for the child. The Kids plan is designed to focus on the child’s well-being, with all benefits directed toward them. The role of the parent or guardian is limited to managing and overseeing the plan on behalf of the minor.

 

  1.  The information you provide is accurate, complete, and up-to-date, and you commit to maintaining its accuracy.

 

  1.  You will use the Services solely for personal, non-commercial purposes.

 

  1.  You will not engage in any use of the Services that is unlawful, harmful, or detrimental to any individual or entity.

 

INDEMNIFICATION

You agree to indemnify, defend, and hold harmless the Company, its affiliates, distributors, agents, service providers, partners, representatives, and other Members, along with their respective officers, directors, employees, and agents, from and against any claims, losses, damages, liabilities, or expenses arising from:

(i) Your use of the Services

(ii) Any breach of the terms of this Agreement by you

(iii) Any negligent or intentional acts or omissions on your part.

 

TERMINATION

The Company retains the exclusive right, at its sole discretion, to suspend or terminate your access to and use of the Services if it determines that you have breached the terms of this Agreement, with or without prior notification. Any suspected illegal, fraudulent, or abusive conduct may constitute grounds for such suspension or termination. Upon suspension or termination, your entitlement to access the Company’s website features and utilize any products, coupons, vouchers, or packages will be immediately revoked. The Company shall not be held liable for any refund of membership fees, claims, or damages arising from the suspension or termination of your access to the Services, or any actions taken in relation to such suspension or termination.

 

GOVERNING LAW AND DISPUTE RESOLUTION

Any dispute, claim, or controversy arising from or relating to this Agreement, including but not limited to its breach, termination, enforcement, interpretation, or validity, as well as the determination of its scope or applicability to arbitration, or to the Services provided, shall be exclusively resolved through arbitration in India. The arbitration will be conducted by a sole arbitrator appointed by the Company, in compliance with the Arbitration and Conciliation Act, 1996. The arbitration proceedings will be held in Tamil nadu, India, and all proceedings, including any awards, shall be in the English language. The arbitral award shall be final and binding on both Parties. Notwithstanding the foregoing, either Party may seek provisional injunctive relief from a court of competent jurisdiction, pending the resolution of the dispute in accordance with the provisions of this Agreement.

 

 

GENERAL PROVSIONS

Severability& Notices

If any provision of this Agreement is found to be unenforceable by a court of competent jurisdiction or an arbitral tribunal in accordance with applicable law, that provision will be severed, and the remaining provisions will continue in full force and effect, interpreted as if the unenforceable provision had never been included. However, the Agreement will be construed to preserve the intent and purpose of the severed provision to the fullest extent permitted by applicable law, as interpreted by the court or arbitral tribunal. All notices and communications under this Agreement must be in writing and in English, transmitted via email, prepaid internationally recognized courier, or hand-delivered by messenger to the addresses specified below or any updated address provided in writing by the respective Party. If to the Company: Via email at info@Prepcohealthcare.com. If to you: To the email address provided during registration or any updated address notified to the Company.

 

Waiver& Complete Understanding

No provision of this Agreement shall be deemed waived, nor shall any breach be excused, unless such waiver or consent is provided in writing and signed by the Party against whom the waiver is asserted. Any consent or waiver granted for a breach shall not be interpreted as a waiver for any other breach, whether express, implied, subsequent, or different. This Agreement represents the complete and exclusive understanding between the Parties with respect to its subject matter, and no other written or oral agreements, understandings, or representations exist between the Parties except as expressly incorporated or referenced herein.

Force Majeure& Conflict of Terms

The Company shall not be held liable for any delay, deficiency, or failure in service caused by events outside its reasonable control, including, but not limited to, acts of God, government actions, natural disasters (such as floods, fires, earthquakes), civil unrest, terrorism, labor disputes (including strikes), failures of internet service providers, or denial of service attacks. In the event of any conflict between the provisions of the Terms of Use, Privacy Policy, Voucher Terms and Conditions, or any other policies governing the Services, the following order of precedence shall apply: 

(i) Terms of Use

(ii) Privacy Policy

(iii) Voucher Terms and Conditions

(iv) Other applicable Service policies.

 

 

TERMS OF USE

 

 

E - CONSULTATION SERVICES &VIRTUAL HEALTH SERVICES

The Company may collect identifiable health information, including details about your physical, physiological, and mental health condition, as well as your medical history and records, as part of its virtual health services. The use of your sensitive personal information, including health data, will be governed by the Company's Privacy Policy. By clicking ‘I accept’ or ‘I agree’ during registration or providing your personal information, you explicitly consent to the Company’s Privacy Policy. You acknowledge that the Company does not endorse or influence any particular branch of medicine, theory, opinion, or viewpoint.

 

You also acknowledge and agree that interactions with healthcare practitioners through audio-visual mediums, as part of the Company's virtual health services, have inherent limitations compared to in-person consultations. These limitations may include, but are not limited to:

(i) Insufficient quality of transmitted information (e.g., poor resolution images)

(ii) Potential delays due to electronic malfunctions.

(iii) Incomplete access to your medical records, which could lead to adverse drug reactions, allergic reactions, or judgment errors.

(iv) The healthcare practitioner’s professional judgment, which may lead to the conclusion that telemedicine services are unsuitable for certain treatments, potentially resulting in the non-provision of services. By using these services, you do so with full awareness of these limitations.

The Company has conducted basic due diligence, such as verifying medical council registration, when engaging healthcare practitioners for virtual services. However, the Company does not guarantee that healthcare practitioners possess any specific qualifications beyond those explicitly communicated to you. You agree to strictly adhere to the advice and instructions provided during virtual consultations. In case of medical emergencies or unfortunate events, such as death, you are required to promptly inform or ensure notification to the help desk. You also agree that the Company may record, store, and retain all tele-consultations, chat consultations, text messages, audio, video, transcripts, prescriptions, emails, and hard-copy correspondences for record-keeping purposes, which may be used as evidence as required by law, in compliance with the Privacy Policy.

Before using the virtual health services, you acknowledge and understand that these services are not designed to replace an existing primary physician-patient relationship. Medical services provided through the virtual platform are based on the healthcare practitioner’s professional judgment, and medication will only be prescribed when deemed medically necessary. Schedule X drugs, such as psychotropic or mind-altering substances, will not be prescribed due to their potential for abuse. These services are not intended for medical emergencies, and you should only use them when no other alternatives are available. Some treatments or services may not be suitable for virtual consultations or may be restricted by telemedicine practice guidelines, laws, or regulations. Healthcare practitioners may also advise against virtual consultations for certain conditions, treatments, or medications.

In some cases, a physical or virtual examination (e.g., via video) may be required before diagnosing, treating, or prescribing medications. If the provider cannot conduct such an examination, they may discontinue the consultation. By using these services, you agree not to hold the Company or the healthcare provider liable for any resulting actions.

The Company disclaims any representations, warranties, and liabilities related to:

(i) The security, reliability, quality, timeliness, or performance of the virtual health services.

(ii) The accuracy or completeness of the professional opinions provided by healthcare practitioners during virtual consultations.

(iii) The timely transmission of data.

 

Furthermore, the Company expressly disclaims liability for:

(i) Pre-existing medical conditions.

(ii) Adverse drug reactions.

(iii) Medical conditions resulting from procedures not associated with the Company.

(iv) Negligence or misconduct by healthcare practitioners engaged in providing virtual health services.

 

Diagnostic Services 

To access health check services, you must comply with specific conditions outlined by the provider, ensuring seamless service delivery. These conditions will be communicated to you and must be adhered to in order to benefit from the health check services offered under the program. Payment for health check profiles should be made directly to the respective laboratory at the time of service provision unless otherwise arranged. Note that the Maximum Retail Price (MRP) of the tests within various profiles may differ between laboratories, which can lead to variations in the savings associated with each profile. The company reserves the right to alter pricing for profiles listed in the membership without prior notice.

Upon confirming your appointment, you are required to complete all tests specified in the chosen health check profile at the designated laboratory. Present the profile voucher at the laboratory before availing of the services. Tests will be conducted as per the voucher’s specifications, categorized as test A or test B. Following the voucher redemption, you are responsible for collecting the test reports from the laboratory. The availability of the medical service provider determines the confirmation of your appointment, whether for in-lab services or home collection. If home collection is unavailable in your location, you may need to visit a nearby laboratory as directed by the helpdesk. This process combines payment procedures, test requirements, and service availability conditions, and it is essential to follow these prerequisites to ensure successful service access.

 

ZUMBA/YOGA/ONLINE FITNESS CLASS

By signing this waiver, I acknowledge the inherent risks associated with participating in Zumba, Yoga, or Online Fitness classes, which may include muscle strains, sprains, falls, and cardiovascular complications due to their physically demanding nature, involving aerobic exercise and dance movements. I understand that online classes may have limitations compared to in-person instruction, with the instructor potentially unable to provide real-time corrections or effectively observe my movements. Therefore, I agree to take responsibility for my own safety and exercise caution during online sessions. Additionally, I certify that I am in good physical health and have consulted with a healthcare professional if necessary, ensuring that I am able to safely participate in Zumba or Online Fitness classes without any medical conditions posing a risk.

 

VIRTUAL CONSULTATIONS

This section outlines the process for virtual consultations at Prepco Healthcare. To schedule a "Virtual Consultation," please contact the Prepco Healthcare Helpdesk to confirm your appointment with the appropriate specialist (such as Dental, Physiotherapy, Nutritionist, General Physician, etc.) and mention your preferred video call method for real-time consultation. Appointments will be arranged based on mutual availability, and you will receive a confirmation email or message with detailed instructions.

The Store-and-Forward Method involves sending recorded health information (e.g., radiographs, photos, videos, lab results) via email or WhatsApp to Prepco Healthcare for evaluation. If abnormalities are detected, our doctors will contact you or send a prescription via email.

Appointments must be scheduled in advance, and any cancellations or rescheduling requests should be submitted at least 2 hours before the scheduled time. We are committed to maintaining the confidentiality and privacy of your information in accordance with applicable laws and regulations. You agree to provide accurate information and conduct yourself professionally during consultations. We reserve the right to decline or terminate services if necessary. The company is not responsible for any actions or outcomes resulting from the services provided.

We reserve the right to accept or refuse any services as outlined in our Terms of Use (Clause 4) and may cancel any services before or during provision. Scheduled consultations may be cancelled if the concerned doctor or specialist is unavailable. Service provision is at our sole discretion, without liability. We may modify, suspend, or discontinue services or methods without prior notice. However, we are not liable for any changes made by surgeons, doctors, medical establishments, labs, hospitals, post-operative care providers, or pharmacies on their respective websites.

 

 

Pharmacy Vouchers/e-vouchers

To avail the benefits of the pharmacy voucher or e-voucher, you must comply with the specified terms and conditions, which govern its proper usage and restrictions. The voucher is strictly limited to the purchase of prescription and over-the-counter medications and cannot be used for non-medical products such as toiletries, cosmetics, or FMCG items. It is applicable exclusively at authorized retail pharmacy outlets and cannot be redeemed at hospital-based pharmacies. This ensures that the voucher is used solely for its intended purpose in the appropriate retail environment.

For the fulfillment of prescription-based orders, a valid prescription from a licensed healthcare provider is required. If the order value exceeds the voucher's denomination, you must pay the difference at the time of purchase; if the value is lower, the remaining balance will be forfeited and is not refundable or transferable. All orders must be placed at least seven working days before the voucher’s expiration to ensure timely delivery. The voucher is valid for a single transaction and cannot be combined with other promotions or discounts. You are responsible for any additional delivery or cash-on-delivery (COD) charges, and the company disclaims any liability for discrepancies in medication prices or adverse effects from their use, in accordance with the Indian Drugs and Cosmetics Act, 1940. Order fulfillment is also subject to product availability, and the company is not responsible for any out-of-stock items.

 

Healthcare @ Home services

Healthcare@home services provide a variety of medical solutions delivered directly to your doorstep, customized to meet your specific health needs, medical diagnosis, home treatments and the service offerings of the provider. The availability of these services is dependent on the resources and capacity of the Service Provider at the time of the request. These services, referred to as "Services," are designed to offer convenient, in-home healthcare tailored to your health requirements and medical condition.

The cost of nursing services is determined based on the severity and complexity of the illness or medical condition being addressed. More severe or complicated cases typically incur higher charges due to the additional resources and care required. To access Healthcare@home services, you must contact the Company’s Helpdesk during business hours, from 8:00 AM to 8:00 PM, excluding national holidays, as some services may not be available on Sundays. Payment for the services is made via debit or credit card directly to the Service Provider, ensuring the funds are deposited into their designated bank account before the services are rendered. Upon submitting your request, a representative will confirm your appointment within 24 working hours, and the designated specialist will visit your provided address. Please note that promotional offers cannot be combined with existing discounts or schemes, and the availability of specialists is subject to their schedules, which may influence appointment timings.

 

EMI Facility

The credit card holder is fully responsible for any interest rates or processing fees that are imposed by the issuing bank of their credit card. These fees are levied directly by the bank handling the credit card transaction, and the Company is not liable for any of these charges. The Company has no control over the interest rates or processing fees associated with credit card transactions, and such fees will not be reimbursed under any circumstances.

In the case of a cancellation, the Company's cancellation policy will apply. If the cancellation request is approved, the Company will refund only the standard amount for the (Prepco Healthcare OPC private limited)Company product. However, the Company will not be liable for the reversal or refund of any interest or processing fees charged by the credit card holder's issuing bank.

Furthermore, the EMI amounts provided for membership are indicative and based on estimated calculations. The actual EMI amount may differ depending on the interest rate applied by the credit card issuing bank. The Company is not responsible for any variations in the interest or processing fees charged by the bank, and these charges are beyond the Company's control.

Referral Campaign Terms & Conditions for PREPCO Healthcare Members and Employees

PREPCO Healthcare, including its successors and permitted assigns, has launched a Referral Campaign targeting both existing PREPCO Healthcare, hereinafter referred to as "Participants" or "You." By participating in this Referral Campaign, You agree to be legally bound by the Terms & Conditions (T&Cs) outlined herein, which form a binding agreement between You and PREPCO Healthcare. You confirm that You have read, understood, and consent to these T&Cs. If You do not agree with any of the terms, You are advised not to participate in the Referral Campaign. PREPCO Healthcare reserves the right to modify, amend, or terminate these T&Cs or discontinue the Referral Campaign at its sole discretion, without prior notice. Eligibility and Participation Guidelines for the PREPCO HEALTHCARE Referral Campaign

The Referral Campaign is exclusively available to current PREPCO Healthcare Members and Employees as of the Campaign's start date, with eligibility requiring active association with PREPCO HEALTHCARE at that time. To participate, eligible individuals must submit referrals to PREPCO Healthcare, which will then follow up to convert these referrals into PREPCO Healthcare Members. Participants who secure the highest number of successful conversions will qualify for Incentives. A "Qualified Referral" refers to any individual referred by a Participant who becomes an PREPCO Healthcare Member during the Campaign Period and maintains membership beyond the 14-day cancellation window, as specified in the Terms of Use. Referrals must be non-PREPCO Healthcare Members at the time of the referral to be valid for the Campaign.

Incentive Rewards and Forfeiture Policy for PREPCO Healthcare Members and Employees

PREPCO Healthcare will determine the top three PREPCO HealthcareMembers and the top three PREPCO Healthcare Employees based on the highest number of successful Qualified Referrals, with eligibility for incentives awarded solely for the number of successful conversions from referrals to Qualified Referrals. PREPCO Healthcare will make two attempts to contact the winners within 48 working hours of the announcement. If unsuccessful, the reward will be forfeited. By participating in the Campaign, participants accept the terms of this forfeiture policy.

All qualified referrals must comply with PREPCO Healthcare Terms of Use, which are available on the PREPCO Healthcare website. By participating, you grant PREPCO Healthcare permission to contact your referrals using the provided contact information, including via WhatsApp or other communication channels. All materials, content, and intellectual property related to the Referral Campaign, including copyrights and trademarks, remain the exclusive property of PREPCO Healthcare and are made available solely for the participant's personal, non-commercial use. PREPCO HEALTHCARE disclaims all express or implied warranties regarding the Referral Campaign, including but not limited to satisfaction of participant needs, communication timeliness, or the reliability of the campaign, and does not guarantee the delivery, quality, or performance of any associated rewards or services.

Incentive/Referral Reward Terms and Conditions

The Incentive/Referral Reward is non-transferable and cannot be redeemed for cash or other items, except as explicitly authorized by PREPCO Healthcare. By participating in the Campaign, participants agree to comply with these Terms & Conditions (T&Cs) and any amendments or additional rules introduced during the Campaign. The issuance of Incentive/Referral Rewards to winners is contingent upon compliance with all applicable statutory regulations, procedures, and formalities, including the submission of necessary documentation required by PREPCO Healthcare for processing the reward. Failure to adhere to PREPCO Healthcare instructions for claiming the reward will result in forfeiture. PREPCO Healthcare reserves the right to revoke the reward in cases of non-compliance. Participants providing false information or withholding material facts with the intent to qualify for the Referral Campaign will be automatically disqualified, including any attempt to deceive PREPCO Healthcare in the selection process.

Indemnification and Liability Disclaimer for Referral Campaign

Participants agree to indemnify and hold harmless PREPCO Healthcare, along with its officers, employees, affiliates, agents, and customers, from any claims, damages, costs, or legal actions arising from a breach of these Terms & Conditions (T&Cs) or non-compliance with applicable laws. Participants are solely responsible for ensuring their participation in the Referral Campaign does not result in legal or financial liabilities, including claims related to the misuse of third-party information or non-adherence to relevant regulations. In case of any legal dispute or claim due to a breach of T&Cs, PREPCO Healthcare reserves the right to defend itself, with the associated defense costs being borne by the Participants. PREPCO Healthcare and its affiliates shall not be liable for any direct or indirect damages, including lost profits or special, incidental, or consequential damages, incurred by Participants or third parties due to the Referral Campaign. The T&Cs are exclusively between PREPCO Healthcare and the Participants, with no rights for third parties to enforce or benefit from these provisions.

Terms and Conditions for Referral Campaign Participation

Winners shall bear sole responsibility for any applicable taxes, duties, or levies related to the Incentive/Referral Reward, including but not limited to tax deductions at source (TDS), gift tax, or any other government-imposed taxes. By engaging in the Referral Campaign, participants acknowledge and waive their rights under the National Do Not Call Registry, consenting to receive promotional communications via SMS, email, phone calls, or other channels concerning both current and future Referral Campaigns. The Campaign is subject to force majeure events, including natural disasters, political unrest, technical failures, or any circumstances beyond PREPCO Healthcare control. PREPCO Healthcare shall not be liable for delays or negative impacts resulting from such events, and will notify participants of any suspension or delay due to force majeure, with the Campaign resuming once the event is resolved.

Referral Campaign Terms and Conditions Compliance and Disclaimers

This Referral Campaign must adhere to all relevant legal requirements and directives from authorized authorities. Any modifications to government regulations may affect the Campaign, and Participants are obligated to comply with such updates. PREPCO Healthcare disclaims responsibility for any technical failures occurring before, during, or after the Campaign, including communication disruptions, delays, or errors that may hinder a Participant’s ability to enter or receive winner notifications. PREPCO Healthcare reserves the right to amend, suspend, or terminate the Referral Campaign at its discretion, including changes to eligibility, rewards, or terms and conditions, with such alterations being immediately applicable to all Participants without prior notice.
